Zones awareness required
Each driver must find out for himself whether a city has introduced an environmental zone and if it is allowed to drive in.
A driver had a painful experience in front of the Magdeburg district court (Az.: 50 OWi 105/18). After he drove into a restaurant parking space and left it after a short time over another exit, he was in an environmental zone again, which he was not allowed to enter with his vehicle. The driver appealed against the resulting fine of 80 euros. The claimant justified his decision by stating that the exit from the parking space at that point was not signposted in an environmental zone. However, the court dismissed the legal action as it emphasised in its pronouncement of judgement that every driver should be personally aware of driving through an environmental zone – even without road signs placed by municipalities and cities. The presiding judge stated, “Each driver should have a “zone awareness”. The judgement has a signalling effect, because similar judgements have been pronounced in other countries with much more complex environmental zones and rules.
